Clause 1 - Title


The name of the Council shall be Drumoyne Community Council (hereinafter called “the Community Council”)


Clause 2 - Objectives and Functions


a)To encourage the community to raise the quality of life of the people living in the Drumoyne Community Council area


b)To take action on the community’s views after consultation


c)To express and co-ordinate to the local authority and other organisations the views of the community on matters these organisations are responsible, particularly on issues such as planning and licencing etc


d)To be in all its activities non-sectarian and non-party political. The Council shall not sponsor, endorse or support candidates for parliamentary or local elections. Similarly, political organisations shall not be permitted to appoint a Delegated Member to the Community Council


Clause 3 - Area Covered


The boundary of Drumoyne Community Council shall be as follows:

on the north side by the River Clyde

on the west side by the City boundary

on the south side by the M8 motorway

on the east side by Drumoyne Road, Drumoyne Avenue, Drive Road then following the Ward boundary to include properties in Aboukir Street and Cressy Street to the Clyde Tunnel

Clause 4 - Sub Areas


The Community Council area shall be divided into 5 sub-areas for the purposes of the election of elected members. The sub-areas and the number of elected members to be elected from each sub-area shall be as follows

The sub area boundaries are shown on the map appended to this constitution. The sub areas shall be reviewed six months prior to each election.


Clause 5 - Composition


The Council shall consist of 15 members comprised as follows

13 elected members

2 delegated members from organisations, in addition

Members of Parliament and Glasgow City Councillors shall be members ex officio

There will be a standing invitation to Members of the Scottish Parliament who represent Glasgow to attend


Clause 6 - Qualification of Candidates


Candidates who wish to stand for election must satisfy the following qualifications:

reside within one of the sub-areas as detailed in Clause 4

be proposed and seconded by residents who live in the same sub-area

be 16 years or over

be listed on the Electoral Register or any supplementary roll prepared by the Community Council for that purpose


Once elected, these members have full voting rights


Clause 7 - Qualification of Voters


To qualify to vote at Community Council Elections, electors must:

be 16 years or over

be listed on the Electoral Roll or supplementary roll

reside within the sub-area to which the candidate has been nominated


Clause 8 - Ex Officio Members


Members of Parliament and Glasgow City Councillors whose Ward falls wholly or partly within Drumoyne Community Council area shall be a member. They have no voting rights but their views concerning the area shall be sought actively


Members or Parliament, the Scottish Parliament and Glasgow City Council shall not be eligible to stand for nomination or election to Drumoyne Community Council


Clause 9 - Community Council Elections


a)Elections will take place every two years in the month of October. Members standing down shall be eligible for re-election.  Candidates must be proposed and seconded by residents of the sub-area in which they stand and whose names should appear on the electoral register or supplementary roll


b)In the event of more than four nominees are received to each of the four sub-areas then a ballot box election will take place for that particular sub-area


c)The location of elections shall be at the discretion of Community councils but should facilitate voting and administration


d)Where vacancies remain, Glasgow City Council shall be informed


Clause 10 - Disqualification of Members


A member will be disqualified when they

fail to reside within the area they represent

fail to attend a meeting having been notified by the Secretary that they have failed to attend three consecutive Community Council meetings without tendering reasons which are satisfactory to the Community Council

fail to attend a meeting having been notified by the Secretary that they have failed to attend six Community Council meetings

accept appointment to a paid office on behalf of the Community Council

are elected to serve as a Councillor on Glasgow City Council, or as an MP or MSP

tender resignation to the Secretary at any time


Clause 11 - Vacancies


In the event of a vacancy occurring, it should be filled within 3 months by election at a public meeting called for that purpose.  Those members shall serve for the remainder of the term of office of the councillor they are replacing and shall have the same voting rights.  If vacancies occur within three months from the date of the next election, they may remain unfilled until such election.  However, if eight or more vacancies arise Glasgow City Council shall be informed immediately to allow it to take such action as it deems appropriate.


Clause 12 - Delegated Members


a) Selection


A list of selected organisations who may wish to appoint a delegated member shall be advertised by the Community Council.  Such an advertisement and selection process must satisfy the conditions in para 4 (b) of the Scheme for the Establishment of Community Councils.  The list of organisations shall be reviewed regularly and shall be reviewed regularly.  Where vacancies remain Glasgow City Council shall be informed


b) Rights and Qualifications


Members who are appointed by the selected organisations shall have the undernoted rights and must fulfill the following qualifications:

have the same term of office of Elected Members

have the same voting rights afforded to Elected Members

do not represent a political organisation

remain as a member of the selected organisation

can be replaced by a new delegate who is appointed by the organisation

membership will be withdrawn where the organisation ceases to exist


c) Disqualification


A Member shall be disqualified where they

fail to attend a meeting having been notified by the Secretary that they have failed to attend three consecutive Community Council meetings without tendering reasons which are satisfactory to the Community Council

fail to attend a meeting having been notified by the Secretary that they have failed to attend six Community Council meetings

accept appointment to a paid office on behalf of the Community Council

are elected to serve as a Councillor on Glasgow City Council, or as an MP or MSP

by tendering resignation to the organisation they represent


Clause 13 - Office Bearers


At the AGM following an election, the Community Council will elect from among their Elected Members office bearers for the Community Council.  The office bearers shall be unrelated and shall include a Chairperson, Vice-Chairperson, Secretary and Treasurer who will, subject to resignation and other requirements of the Constitution, hold office for the period of their appointment to the Community Council.  The Community Council may include other office bearers from time to time if it so chooses. The term of office shall be two years


All office bearers are eligible to be re-elected at the ordinary election as Community Councillors. If so re-elected, all office bearers, with the exception of the Chair, will be eligible to be re-elected by the Community Council to hold any office which they previously held.  The exception to this is the office of Chairperson who may only be re-elected if there is no alternative candidate. Where there is one alternative candidate, the alternative candidate shall be elected and the previous Chairperson shall not be eligible to stand for re-election. Where there is more than one alternative candidate an election by ballot shall be carried out and the previous Chairperson shall not be eligible to stand for re-election


Clause 14 - Meetings


a) Quorum


A quorum for all Community Council meetings shall be 5. If a quorum cannot be achieved then the meeting must be convened at a later date.


b) Annual General Meeting


The Annual General Meeting which shall be publicised in the local press and prominent areas fourteen days prior to the meeting shall be held in October to

approve the annual report

approve the audited accounts

note the appointment of auditors

and if necessary

conduct or report on the election of Elected and Delegated Members


Once approved the extract of audited accounts shall be forwarded to the Community Councils’ Resource Centre


A returning officer shall be appointed to oversee the election process


c) Public Meetings


At least one public meeting other than the Annual Meeting shall be called.  The public will have the right to speak and should be given every reasonable opportunity to be heard


d) Ordinary Meetings


Ordinary meetings of the Council will be held once per calendar month with the exception of July and August when the Council will be in recess. The Executive and five ordinary Members shall have mandatory powers during recess. The press and public will have the right to attend all meetings.  The Council will have the right to exclude them from certain agenda items where there are exceptional circumstances in order to consider in private any items of business or a private or confidential nature where it would be in the Community interest to do so


Members of the public may speak only with the consent of the Chairperson.  An agenda for every meeting will be circulated at least seven days before the meeting.  Items for inclusion on the agenda of a Community Council Meeting must be intimated by any resident or elector in writing fourteen days prior to the commencement of the said meeting.


All advertisements intimating the time and place of Community Council meetings will be published at least seven days prior to the meeting taking place.  An agenda for every meeting shall be circulated to all members at least three days before the meeting.  The meetings will be advertised widely so that all the electorate has the opportunity to be informed of the meeting.  Three or more public places in the Community Council’s area must be identified at which notices will always be places to advertise meetings.  These advertising points will be intimated to the public and notified to Glasgow City Council via the Community Councils’ Resource Centre


The Community Council will meet at least four times during the course of the year


e) Publicising Meetings


Meetings of the Council will be published at least seven days prior to the meeting taking place


f) Special Public Meetings


A Special Public Meeting will be held by the Community council on receipt of a written request signed by twenty Community Council electors of the area once the requirements of this clause are held by the Community Council to have been satisfied. The petition shall specify the matter and the reasons for such a meeting.  Once the Community Council finally expresses itself to be satisfied that the petition be competent, relevant and accurate the meeting will take place within three months of validation.  The public meeting will then only be held when the Community Council can be satisfied that all arrangements in connection with the holding of the Public Meeting are in a place such as to satisfy the Community Council’s duty of care and responsibility in the calling and holding of a Public Meeting


g) Emergency Meetings


In cases deemed to be an emergency, a Community Council meeting may be held without giving seven days’ notice.  The Chairperson and at least one other Member must be satisfied that the business to be discussed is urgent.  All Members shall be notified of such meetings and a quorum must be present before business can be conducted


h) Invitation to Officers


The Community Council may invite officers of Glasgow City Council to any or all of its meetings, committee meetings and sub-committee meetings.  These officers shall not be invited to vote at any meeting


Clause 15 - Sub-Committees


The Council may form a sub-committee of at least three members to consider specific matters.  The terms of reference, powers, duration and composition shall be recorded in the minutes of the Council


Clause 16 - Advisor


The Council may appoint an advisor to give advice on special, technical or other matters requiring particular expertise.  Such an advisor who does not have a vote may only speak on agenda items relating to those matters and their attendance cannot be counted towards the quorum


Clause 17 - Minutes of Meetings


Minutes of meetings shall be distributed to all Elected, Delegated and Ex Officio Members at least seven days before the next Community Council meeting.  Once approved, the minutes should then be forwarded to the Community Councils’ Resource Centre after approval by the Council and be available for inspection by the public


Minutes shall record:

the date, time and place of the meeting

the names and status of those Members and other persons attending the meeting

the names and status of those Members unable to attend but who have presented apologies for non-attendance

all decisions taken, and actions approved

the date, time and place of the next meeting


Clause 18 - Finance and Accounts


a)once approved at the annual Public Meeting an extract of audited accounts should be forwarded to the Community Councils’ Resource Centre

b)in addition to any grants obtained, the Council can raise money on its own

c)the Community Council shall nominate at least three unrelated office bearers to act as signatories to the Community Council bank account. All cheques and withdrawals from the Council’s bank account shall require two out of three signatures on the mandate: Chairperson, Secretary or Treasurer

d)any changes to the authorised signatories should be approved by the community council


Clause 19 - Property


An inventory of all property, equipment and materials owned by the Council shall be maintained and made available to the auditor at the annual audit.  Title to heritable property shall be held in the names of the Chairperson, Secretary and Treasurer. Their successors shall take over this responsibility


Clause 20 - Alterations to the Constitution


Alterations to the constitution shall only be made at a public general meeting or at a special general meeting called for that purpose.  Notice for any such proposed alterations shall be intimated in the notice of the meeting.  Proposed alterations to the Constitution must be submitted in writing at least three weeks before the meeting.  The Secretary shall make them available for inspection, such alterations must be carried by two thirds of those present who are eligible to vote.  Such alterations shall not take effect until approved by Glasgow City Council


Clause 21 - Provision of Standing Orders


The Council may draw up and amend from time to time Standing Orders as it things necessary for the proper and efficient conduct of business. A copy of the Standing Orders can be found in Appendix 2


Clause 22 - Suspension


The Council may be suspended by Glasgow City Council if it is not conforming to the Scheme for the Establishment of Community Councils and revert to the status of a Steering Committee


Clause 23 - Dissolution


If the Council by two thirds decides at any time, on whatever grounds, that it is necessary or advisable to dissolve the Community Council, it shall publish the terms of the proposed resolution throughout the area and shall carry out normal procedures for informing local opinion before putting the proposed resolution to a vote at a public meeting.  Once a decision has been taken to dissolve the Community Council any assets and funds shall be transferred to Glasgow City Council after satisfaction of any proper debts or liabilities


Where Glasgow City Council has reasonable grounds to believe that a Community Council has been abandoned and is no longer operating, then it may dissolve immediately that Community Council and intimate this action by public notice


Where Glasgow City Council has reasonable grounds to believe that a Community Council is diverging significantly from the Scheme then it may dissolve immediately that Community Council and intimate this action by public notice


Clause 24 - Constitutional Documents


This Constitution is subject to the provisions of the Scheme for the Establishment of Community Councils and any Operational Guidelines issued from time to time by Glasgow City Council and shall be construed with reference to these documents


Clause 25 - Equal Opportunities


Drumoyne Community Council will ensure that it operates an equal opportunities policy.


Clause 26 - Adoption of the Constitution


This Constitution, after being agreed by Drumoyne Community Council, was adopted at a public meeting held on (date) at (place)
